This policy describes how Banana Joe Games Srls (hereinafter, "Banana Joe Games") processes the personal data of users who visit bananajoe.games and make purchases through the online store, in accordance with EU Regulation 2016/679 ("GDPR") and Italian Legislative Decree 196/2003 as amended.

2. Categories of Personal Data Processed

  • Contact information: first name, last name, email address, postal address, phone number, billing and shipping addresses.
  • Payment information: processed directly by authorised providers (Shopify Payments, Klarna, Shop Pay and others) and not stored in Banana Joe Games systems.
  • Account information: where the user creates a profile, username, password (in encrypted form), preferences and order history are collected.
  • Browsing information: IP address, device identifier, browser, operating system, pages visited, session duration, products viewed, data collected through cookies and similar technologies.
  • Communications: content of emails, messages and support requests sent to Banana Joe Games.

3. Purposes and Legal Basis

  • Performance of the sales contract (art. 6.1.b GDPR): processing of orders, payments, shipments, returns, post-sale support.
  • Legal obligations (art. 6.1.c GDPR): tax, accounting, statutory warranty and anti-money laundering compliance.
  • Legitimate interest (art. 6.1.f GDPR): site security, fraud prevention, service improvement, aggregated statistical analysis.
  • Consent (art. 6.1.a GDPR): newsletters, marketing communications, profiling and non-essential cookies. Consent is optional, may be withdrawn at any time, and does not affect the ability to purchase.

4. Processing Methods

Data is processed electronically with technical and organisational security measures adequate to prevent unauthorised access, loss or unlawful processing. Storage is hosted by Shopify Inc. and by the e-commerce service providers.

  • Shopify Inc. (e-commerce platform, hosting, payment processing).
  • Payment providers (Shopify Payments, Klarna, Shop Pay, Apple Pay, Google Pay).
  • Couriers and logistics operators responsible for shipments.
  • Email marketing providers (e.g. Klaviyo), where the user has given consent.
  • Analytics providers (e.g. Google Analytics, Meta Pixel), within the limits of the consent granted.
  • Tax, accounting and legal advisors, for statutory compliance.
  • Public authorities, upon motivated request and in cases provided by law.

Data is not sold, transferred or disclosed to third parties for purposes other than those listed.

6. Transfers Outside the EU

Some providers (in particular Shopify Inc.) are located outside the European Economic Area. Transfers take place on the basis of the Standard Contractual Clauses approved by the European Commission or other mechanisms provided by artt. 44-49 GDPR.

7. Retention Periods

  • Order-related data: ten years, in compliance with tax and civil law obligations.
  • Account data: until the user deletes the profile.
  • Marketing data: until consent is withdrawn.
  • Browsing data and cookies: as indicated in the Cookie Policy.

8. Rights of the Data Subject

  • Access to one's data.
  • Rectification of inaccurate data.
  • Erasure ("right to be forgotten").
  • Restriction of processing.
  • Data portability.
  • Objection to processing.
  • Withdrawal of consent, without prejudice to processing already carried out.
  • Complaint to the Italian Data Protection Authority (www.garanteprivacy.it).

Requests can be sent to info@bananajoe.games. Banana Joe Games responds within thirty days from receipt, save for a justified extension.
